However, those 3000 people who died in the twin towers had nothing to do with foreign affairs of the US. Even, there is a possibility that there was a person who did not align his views with US's foreign policy, and now that person's family would not be any supporter of nations who are in need of support. In 1979, King (Shah) Mohammad Reza PAHLAVI left Iran, and He said to reporters that He was leaving Iran because He did not want anymore bloodshed in His beloved country. Now, it does make sense what He was telling us. Just rewind clock of history in Iran, it was during World War II, Russia and England invaded Iran, even Iran declared itself a neutral country, Russia and England careless about Iran's position, and invaded Iran, and began to plundering Iran's oil for their war machinery. King Reza PAHLAVI abdicated from His Throne because Russia and England did resented King Reza PAHLAVI due to His modernization plan for Iran, making Iran a nation-state, as He moved Iran from a conservative base on religion (theology) state and society to a rational and a secular state.

The above superpowers and other ones were thinking that by allowing young princes Mohammad Reza PAHLAVI to ascend to throne, it would be easy to manipulate Him, as well as, preventing Iran from progress. However, the Western powers were wrong, King Reza PAHLAVI continued with His version of modernization of Iran, as it became glorified during celebration of 2500 ceremony in Iran, and Iran indeed moved from a conservative wisdom to a norm and liberal minded society.

The Western power like England, France, and US were not please with King Mohammad Reza PAHLAVI's agenda for Iran. It was during Jimmy CARTER's presidency as he ignited fire in Iran, and besmirched the legal system in Iran to be in violation of human rights. The legal system improved its standard in order to meet Red Cross, as well as, the united Nations recommendation. However, the US did not stop interfering in Iran's domestic affairs, CARTER continually pushing agenda of human rights in Iran. King Mohammad Reza PAHLAVI left Iran in peace.

Now, looking at North Africa and, particularly, Gaddafi's incident as NATO special forces were roaming around the Libya to topple the regime in Libya it would happened in Iran. Consequently, King Mohammad Reza PAHLAVI left Iran in order to stop the bloodshed. Otherwise, the US would launch massive air and ground attack on Iran under elusive banner of freedom for Iran.

Decoding Emblem of Islamic Republic of Iran

In 1979, the Pahlavi Dynasty collapsed and it was replaced by theology state of Islamic Republic of Iran (IRI). One, it is interwoven and there is a a wave on top, in Persian grammar it repeats a letter as counting would be repeated. Interestingly the wave symbol is symbolized the All Seeing Eye. In addition, there is a pentagram in the flag by attaching far corners to each other it gives a pentagram as pentagram would intercept by the area of the wave. Last, the flag was anti-Christ because it is an up-side down Cross. It may claim that it is a sword which is not because it has no grip.

There are some individuals that they claim in Iran there was a Freemason lodge with name of Forough which assisted His Excellency Amir Abbas HOVEIDA to be appointed to the Prime Minister's Office.

The above allegation would be not have any merit because Freemason was a new concept for Iranian community, and when His Excellency was appointed to the high office, the Freemason was a private club which would not allow other race but white male person to join the club. Recently, the club was facing decline in membership, and began to alter its policy by allowing other faith groups, as well as, race to join the Freemason Society.

The Freemason Society did not support Monarchy state. The Freemason Society always brought people to one common denominator in order to revolt against monarchy establishment. Usually banner of the Freemason Society was about democracy, liberty against tyranny. The Freemason Society deemed the monarchy system as a despotic system, and assisted to mobilize people against the establishment which became evident during French Revolution as the Freemason's lodge would be a place to disseminate information with one another. In addition, the Forefather of the US opposed the idea of the Constitutional Monarchy and formed a republic in the US.

The Freemason Society was one controversial society which had a deep root in European history. There were allegation that the above society incorporated Illuminated doctrine, as well as, Theosophy doctrines. The above societies did not have good reputation, and there were allegations of Satan worship. Alex Jones made a documentary, and it should not be taken as an absolute truth, but he documented that world leaders were taking part in worshiping Satan.

Beside the idea of worshiping Satan, it did make sense that former US President CARTER did not like Pahlavi Dynasty in Iran, and decided to topple the regime in Iran. As a result, there are cloud of doubts looming on the book as how truthful is this author with his readers.

This author contradicts himself on major points as follow.

1.This author on page 10 asserted that "and it wasn't as if the Iranian government could not close down the opium dens if it wanted to. Iran is a police state. Every day I drove around Tehran, or walked around the streets and bazaars, I was stopped and my papers checked." On page 77 this author claimed that "Iran is not a totalitarian state run by "Islamofascists" who believe they're in some quixotic war with the West." Input: Police state and totalitarian state shared same meaning as a state controls every fabric of a society, as this author experienced in Iran under rule of the mullah in Iran.
2.This author on page 207 claimed that "since 9/11, without any evidence, these people have tried to make the case that Muslims intend to infiltrate the United States, bring down from inside, and convert us to Islam." On page 230-231 this author was talking with Muhammad British-Pakistani born who made a remark about 7/7 which was the way to go and "accept Allah's law," he said. "End of story. Accept Allah's law and I think you'll have a peaceful life." In other words, we either convert to Islam or die." Input: There is a reality that Muslims are planning to convert Western nations to Islam or they have to die.

Author's theory frame work for the cleric regime in Iran:

The regime in Iran is not a great power either which would have economic, military, diplomatic and cultural strength. The current regime in Iran is a rouge state, which is an authoritarian regime, absent of human rights, and seeking weapon of mass destruction.
2.This author was claiming that the regime in Iran is no longer relying on terrorism to advance its interest. However, the cleric regime has been targeting Iranian dissidents and have been murdering them around the world.
3.This author on page 15 claimed that the US do not understand the regime in Iran because of Iranian dissidents are lobbying the White House and the White House does not have clear understanding of Iran. According to the record, so far element of the cleric regime on individual base or as a council like National Iranian American Council had opportunity to meet senior staffs and elected politicians, and to mislead the White House and not Iranian dissidents.
4.This author is working on fear tactic that price of oil on rise and on page 198 this author says it is in best interest of the US to negotiate with the regime in Iran. However, he does not provide any information or strategy how to negotiate with the regime in Iran.

It was very puzzling that the US was pursuing policy of regime change in Egypt, and all of sudden it made sense when the TIME magazine mentioned Honsi MUBARAK received his military training in Russia. The article left an impression that since Russia was nemeses of the US, it made Mr. MUBARAK unreliable allied to the US. The article mentioned that after Camp David, 1979 treaty, Egypt was sending recent recruit officers to the US for military training which made them more flexible in regard treating civilians. This portion of the article sent another shock wave that Imperial Iranian Armed Forces during reign of monarchy were trained in the US, and this magazine was cheering for their execution in 1979.

It became clear after reading the Economist, and the TIME magazines that the only reason Egyptian officers did not open fire at demonstrators because they were trained in the US. It was possible that these officers were loyal to the US. In addition, there was a person with name of Wisner who was consulting MUBARAK on foreign and domestic politics and he too like past time of Iran, pushing agenda of human rights with Mubarak. Thus, the US decided to appoint someone in Egypt that s/he would be allied of the US without any kind of Marxist history. Furthermore, the US is using the moment to transform the African nations by eradicating Russia's allies, and establishing the US friends in order to control the region.

Perhaps, the above events explained why Prince Ali Reza PAHLAVI had to die so Crown Prince Reza PAHLAVI would know that He was not allow to emancipate Iran.

On Monday Feb 14th, 2011 Sanea Jaleh, a 26-year-old was killed by security forces in Iran. Of course, the security forces in Iran are not Iranians, they are from other region of the world that mullahs brought in Iran to suppress Iranians.

Lying is a huge industry in Iran, and the mullahs with their associates like Revolutionary Guards, Besij, and plain clothes are good at lying.

I hope, one day, Iranians would wake-up and realize by following mullahs whether he is wearing a green turban, or white turban, or anything associated with the regime in Iran is not a solution for their problems, but total removal of the rouge IRI was the only key to a better future for everyone. "We're very disappointed that Canada has accepted these people who are directly related to the dictatorship and to the family that has been ruling Tunisia for the past 23 years," said Haroun Bouazzi, of the Collectif de solidarite au Canada avec les luttes sociales en Tunisie.

Bouazzi, who was born and raised in Tunisia but has lived in Canada for the past 11 years, said the Canadian government should have refused entry to Ben Ali's family even if they were carrying the proper documentation.

"When Ben Ali left Tunisia, he was still president, and countries like Malta and France didn't accept him even then," he said. "Countries always have a choice to be on the side of the Tunisian people."

An official at Citizenship and Immigration Canada said Saturday that Ottawa was not offering asylum to Ben Ali's family.

Ben Ali fled to Saudi Arabia this month after weeks of violent protests against his iron fisted rule.

Yesterday, hundreds of Tunisians defied a night-time curfew and camped out in front of Prime Minister Mohammed Ghannouchi's office in a bid to force the government to resign.

Protesters said the revolt against Ben Ali has not gone far enough and should be followed up by the removal of all old-regime figures from the leadership and the abolition of Ben Ali's powerful RCD party.

In addition, it would be unthinkable to think that Ali Reza PAHLAVI took his own life due to his younger sister's death tragedy as she ended her own ilfe back in 2001 because he had first hand experience about the emotional impact about suicide on family members.

It would be savvy to look into detail of death of Leila PAHLAVI. It was summer of 2001, she took her life in England. On September 09th, 2001 Shah Mansour was assassinated in Afghanistan. On September 11th, 2001 the world trade centers collapsed as the war on terror began.

The Islamic Republic of Iran is controlling federal, provincial and local Canadian politicians by having lobby groups like Iran Canada Business Council which is making political campaign contribution to the Canadian politicians. On August 14th, 2003 the Immigration and Refugee Board of Canada released a report {IRN41817, E}about role of the Revolutionary Guard Corps which was controlling Iran's construction industry, and had closed ties with the cleric circle in Iran. Mr. TABRIZI is involved in construction industry in Iran. In addition, Canada allowed cleric Rafsanjani who is an infamous international terrorist to build Highway 407, and Center Point Mall with his family in city of Toronto, Province of Ontario. Most importantly, it was against Criminal Code of Canada section 83.03 to allow a terrorist entity like Rafsanjani to use Canada as an economic base.

In March 1992 Canadian Security Intelligence Service released a report of the rouge state in Iran's ambition to pursue nuclear power by Dr. R. HENDERSON. It was, in 1978, when Khomeini HENDI used British Broadcasting Corporation to spread its propaganda in Iran, and he claimed that he was descendant of Prophet Muhammad Peace Upon Him, and never would lie to anyone. So, he made pact with Iranian.

1.Creating a Marxist-Islamist Utopia.
2.Respecting safety and security of Imperial Iranian Armed Forces.
3.Freedom of speech.

In February 1979, Khomeini returned to Iran after fifteen (15) years of exile, and when one American reporter, in the airplane, asked Khomeini, how did he feel about returning to Iran? He said nothing. He had no feeling to Iran. As this child of Prophet Muhammad landed in Iran, he did not waste any time, he formed firing squads and commenced to executed members of Imperial Iranian Armed Forces in order to prevent any possible military coup. The widows did not have chance to say good bye to their loved one, as the Marxist-Islamist factions began to confiscate assets of Imperial Iranian Armed Forces and families left destitute. Some of these families fled Iran, and some went back to their parents' houses.

Khomeini did not want to share political sphere with anyone as he gave himself title of Ayatollah/Sign of God, and Ro-Ho-Llah which means Spirit of God. Interesting, in Islam, it was forbidden to associate anything to God, it was constituted as blasphemy sin, and punishment was death, but he did.

Khomeini asked the left-wing factions to speak freely in Iran, as the Marxist Factions would appear before cameras, and would discuss utopia. Once, these left-wing factions were identified, the freedom of speech of abolished, and Iran's prisons were filled with the left-wing factions. The regime had one solution for these individuals in the prisons. Let's purge them all. In case of young ladies that they were not married. They had to be touched in order to prevent them from entering garden of heaven. The Revolutionary Guards, Paramilitary (Besij) and any other form of Iron Fist of the regime commenced to illustrate their loyalty to the regime by taking part in touching the ladies in the prisons, and their execution in the glory of Prophet Muhammad and Allah.

According to the below video clip, it illustrated that in Iran's culture it was rude to kiss another man's hand, as MOUSAVI and others were kissing Khomeini's hand. Plus, Koran was above Khomeini, and Koran in Chapter 5 verse 51 and Chapter 9 verse 29 mentioned God did not like arrogant people.

The Green Movement in Iran

It is difficult to believe Mr. Mir Hussein MOUSAVI, who took part in purging, in 1988, political prisoners by feeding them rat poison, now he is acting as some form of dissident against the cleric regime. It is also hard to believe Mr. MOUSAVI, who is cousin of Sign of God/Ayatollah Khameine, would do anything to undermine the legitimacy of his cousin. Especially, in Iran family ties are deep, and it would not be that easy for someone to take certain action against his own family. Particularly it is troublesome to believe, Mr. MOUSAVI is against the establishment in Iran because this normative control model system would not allow any individual to be part of the system, unless he has proven his loyalty to the system. So, why all of sudden Mr. MOUSAVI decided to be outspoken about the regime in Iran? Mr. MOUSAVI took part in plundering Iran's wealth, and why all of sudden his conscience is disturb by the establishment in Iran? And the regime in Iran would eliminate any individual for undermining fundamental principles of the regime in Iran. So, why is the regime in Iran not eliminating Mr. MOUSAVI?

The key point is that any rational mind should view the regime in Iran as a cunning fox. This is the regime which is good at playing games with others, and a rational mind should think that how the regime was gaining from the Green Movement in Iran. The regime in Iran was facing harsh criticism over nuclear proliferation. It reached to a point that Israel openly was calling for air strike on nuclear facilities in Iran. The democrat US Administration wanted to have appeasement with the regime in Iran, and in return the regime in Iran would give-up on nuclear proliferation. However, the regime in Iran did not give-up on its core principle of nuclear proliferation, and remain steadfast to develop nuclear facilities, and AHMADI NEZHAD was calling for destruction of Israel, as well as, US. Thus, the system came-up with game of Green Movement in Iran in order to distract International Communities from nuclear proliferation to velvet revolution in Iran while the regime in Iran was increasing its nuclear proliferation, and asked from Kazakhstan for high enriched uranium. Plus, the current upheaval enable the regime to dodge sanction, and given hope to the Israel and the US that the regime in Iran was going through transformation, and there was no need to be concern about nuclear programs. Let's be hopeful that the regime in Iran will change.

What is defamation?
Defamation is communication about a person that tends to hurt the person's reputation. The communication must be made to other people, not just to the person it's about. It can be spoken, which is called slander, Or it can be written, which is called libel. It can also be a gesture, which is a type of slander.

The law protects your reputation against defamation. If someone defames you, you can sue them to pay money (called “damages”) for harming your reputation. You have to sue in Supreme Court, not Provincial Court, and you have to sue within 2 years of the defamation. For more on the court system, check script 432, called “Our Court System and Solving Disputes.” You don’t have to prove that the people who heard or read the defamation actually believed it. Even if they knew it was false, it can still be defamation. Courts realize that lies can take on a life of their own.

The law doesn't protect you from a personal insult or a remark that injures only your pride; it protects reputation, not feelings. So if someone calls you a lazy slob, you might be hurt, but you probably don't have a good reason to sue. If he goes on to say you cheat in your business dealings, you probably do have a good reason to sue, as long as he says it to someone else, not just to you. If he says it only to you, you can't sue because he has not hurt your reputation.

Defamation can be a crime under the Criminal Code, but only rarely. This script is about civil, not criminal, defamation. If someone has defamed you, you may also be able to sue for a violation of your privacy under the provincial Privacy Act. Further, section 7 of the BC Human Rights Code prohibits another type of defamation, namely, a discriminatory publication. What is libel?
Libel is the type of defamation with a permanent record, like a newspaper, a letter, a website posting, an email, a picture, or a radio or TV broadcast. If you can prove that someone libeled you, and that person does not have a good defence (see the section on defences below), then a court will presume that you suffered damages and award you money to pay for your damaged reputation. But going to Supreme Court is expensive and even if you win, you may not get as much as it costs you to sue. In deciding on damages, the Court will consider your position in the community. For example, if you are a professional, damages may be higher.

What is slander?
Slander is the type of defamation with no permanent record. Normally it's a spoken statement. It can also be a hand gesture or something similar. The law treats slander differently than libel: with slander, you have to prove you suffered damages, in the form of financial loss, to get compensation. But with libel, the law presumes you suffered damages. For example, say that Bill told John you were a cheat, and then John refused to do business with you because of that. You sue Bill and prove that you lost business with John because of what Bill said. Bill would have to pay you for the loss of John's business, but not for the general damage to your reputation. It can be very hard to prove this sort of financial loss. That's why most slander cases never go to court.

But in the following four examples, a slander lawsuit may succeed without your proving financial loss. Even though there's no permanent record of the slander, the law will presume damages, as if it were libel, if someone:

accuses you of a crime (unless they made the accusation to the police)
accuses you of having a contagious disease
makes negative remarks about you in your trade or business
accuses you of adultery

What about the right to free speech?
The law protects a person's reputation but this protection can restrict other rights, such as the right to free speech. The law tries to balance these competing rights. Sometimes, even though someone made a defamatory statement that hurt a person's reputation, the law considers other rights more important. The law allows the following defences for a person who makes a defamatory statement.

What are the defences to a defamation lawsuit?
If someone sues for defamation, the most common defences are:

truth (known in law as "justification")
absolute privilege
qualified privilege
fair comment

1. Truth or justification
A statement may hurt your reputation, but if it is true, anyone who says it has a valid defence if you sue them for defamation.

2. Absolute privilege
There are two main examples of this defence: statements made in Parliament and statements made as evidence at a trial or in court documents. But this privilege does not apply if a person repeats their evidence outside a courtroom. This defence also allows the fair and accurate reporting of these statements in the media, such as newspaper reports of a trial. People must be able to speak freely in our justice and political systems without worrying about being sued.

3. Qualified privilege
Say a former employee of yours gave your name to an employer as a reference and that employer calls you for a reference. You say, "Well, frankly, I found that this employee caused morale problems." As long as you act in good faith and without malice, and your statement is not made to more people than necessary, then the defense of qualified privilege protects you if the former employee sues you for defamation. You gave your honest opinion and the caller had a legitimate interest in hearing it.

4. Fair comment
We all are free to comment – even harshly – about issues of public interest, as long as our comments are honest statements of opinion, based on fact, and not malicious. For example, a newspaper columnist may write that a Member of Parliament (an MP) says he supports equality and equal rights, but he opposes same-sex marriages. The columnist writes that the MP is hypocritical. If the MP sues the columnist for defamation, the columnist has the defence of fair comment. Media articles that accurately report what was said at public meetings are also privileged, unless the meeting was not of public concern and the report was not for public benefit.

What effect does an apology have?
A newspaper or a TV or radio station that publishes or broadcasts a libel can limit the amount of the damages they may have to pay by publishing or broadcasting an apology right away.

Summary
The law of defamation protects your reputation against false statements. If a person makes a false statement to someone and it hurts your reputation, you can sue the person who made the false statement for damages. But because of other competing rights in our society, such as free speech and fair comment, you will not always win.

Note: The information provided in this document is of a general nature and does not constitute legal advice. Moreover, it addresses only some issues in defamation law, and only under the law in Ontario, Canada. While the law of defamation in other common law jurisdictions (e.g., other provinces in Canada excluding Quebec, England, Australia, the USA) is based on similar principles, it can vary in important respects. Introduction

As an inexpensive and accessible medium of worldwide communication, the Internet offers individuals unprecedented new opportunities to publish and share information and opinions. Messages posted on websites or in discussion forums have a potentially vast audience, and can be replicated almost endlessly. This means that defamatory statements published on the Internet can have wide repercussions for affected individuals or corporations.

In a June 2004 case, Barrick Gold Corporation v. Lopehandia, 2004 CanLII 12938 (ON C.A.), the Ontario Court of Appeal increased a trial judge's damage award for internet-based defamation from $15,000 to $75,000, with an additional $50,000 punitive damages, on the grounds that Internet defamation has a distinctive capacity "to cause instantaneous, and irreparable, damage to the business reputation of an individual or corporation by reason of its interactive and globally all-pervasive nature", as well as its potential for being taken at face value. The company in this case was able to prove actual harm by showing that its shareholders had seen the defamatory statements. It should also be noted that defendant did not defend himself in the appeal.

At the same time that the online context can exacerbate the harmful effects of defamation, it serves as an important vehicle for free speech. Efforts to protect reputation need to be balanced against the public interest in maintaining the potential of the Internet as a medium of public discourse. The law of defamation needs to protect people from cyber-libel without squelching legitimate free speech. Lawsuits that allege defamation in order to curtail fair criticism - known as "SLAPPs" (Strategic Lawsuits Against Public Participation) - should not be permitted, either online or offline.

F.A.Q.

What is defamation?

Defamation is the unjust harming of another's reputation by libel or slander. Libel is defamation in a fixed medium (such as a written story, a cartoon, a videotape, etc.), while slander is of an oral nature (spoken words).

Someone alleging defamation must prove three things:

That the words used by the defendant were "defamatory";
That the words referred to the plaintiff; and
That the words were published to a third party.

In three provinces (Ontario, British Columbia, and Saskatchewan), libel and slander actions are treated differently from each other. In these provinces, the plaintiff in a libel case does not need to show that he has suffered any losses that can be exactly quantified at the time that the trial starts; whereas the plaintiff in a slander case, must prove such a loss to be able to sue, except in four cases (related to work or business, accusations of criminal offences, imputations of diseases, and unchastity of a woman). This difference in treatment between the two actions has been abolished in the other provinces.

Who can sue for defamation?

Both corporations and individuals can sue, or be sued, for defamation. However, it has recently been confirmed that municipal corporations (municipalities) cannot sue for defamation. (Halton Hills (Town) v. Kerouac, 2006 CanLII 12970 (ON S.C.)) This does not imply that individual city councilors cannot sue for defamation on their own behalf using their own funds.

What are "defamatory words"?

Defamatory words are statements that, in the eyes of a reasonable person, discredit the plaintiff.

Speaking of the "reasonable man," Canadian courts have said:

"...He is a person of normal intelligence who makes prudence a guide to his conduct. He does nothing that a prudent man would not do and does not omit to do anything a prudent man would do. He acts in accord with general and approved practice. His conduct is guided by considerations which ordinarily regulate the conduct of human affairs. His conduct is the standard 'adopted in the community by persons of ordinary intelligence and prudence' " (Arland v. Taylor, [1955] 3 D.L.R. 358 (Ont C.A.))"

"A reasonable person will generally refrain from giving out unfavourable information about other people if he or she has reason to doubt the truth of the information." (Prud'homme v. Prud'homme, [2002] 4 S.C.R. 663 at para. 36)

When the law says that the words must be discrediting, it means that they must somehow harm, injure, disparage or adversely affect a person's reputation. The Court will apply an objective test here, that is, the statement is judged by the standard of a reasonable reader or listener.

Once the defamatory character of the statement is established, the Court will presume that the words are false. It is up to the defendant to establish that they are true. Minor inaccuracies will not count if the words are essentially true. In other words, a plaintiff will not win by nitpicking. (See "What is justification?", below.)

It is therefore a good idea for anyone publishing material that discredits another person to keep copies of any evidence that could help to establish the truth of the statements. Such evidence will also show that you took steps to verify the truth of the statements should you ever be sued.

To whom must the words refer?

Plaintiffs in a defamation case must prove that the words refer to them, either directly or by reasonable implication. The document need not identify them by name in order to be considered defamatory, but it must refer to them. The court will look at all the circumstances surrounding the publication in order to determine whether this element is proven.

What is meant by "a publication"?

To establish the tort of defamation, a plaintiff must establish that the defamatory words were "published". This does not mean printed in a public document; rather, the law simply requires the words were communicated to a person other than the plaintiff. Posting defamatory material on a website or newsgroup constitutes publication, as does sending a letter or email to another person. Posting a hyperlink on a website to another website that has posted defamatory material does not constitute publication unless this hyperlink clearly indicates that it is referring to a defamatory statement on another website. (Crookes v. Wikimedia Foundation Inc. 2008 CanLII 1424 (BCSC))

What are the possible defences to defamation?

Various defences are available to people who are accused of defamation. A defendant to a defamation lawsuit can succeed by proving any of the following:

Justification (i.e., truth),
Consent,
Absolute privilege,
Qualified privilege (and lack of malice),
Fair comment (and lack of malice), and
Innocent dissemination, and
Responsible journalism.

What is "justification"?

"Justification" refers to truth of the statement. In Canadian common law provinces, truth is a complete defence to defamation. This is not the case in some Australian states, South Africa, and some US states.

This is also not the case in Québec where the Supreme Court confirmed in 2004 that it was possible to tell the truth and still be liable for defamation (Gilles E. Néron Communication Marketing Inc. v. Chambre des notaires du Québec, [2004] 3 S.C.R. 95.) In Quebec, the truth or falsity of a statement is not conclusive because what is essential is the existence or absence of a fault. A fault in Québec civil law is loosely defined as behavior that strays from how a person should normally behave towards others. Even if the statement is true, the way in which the statement is made can still constitute a fault. In Néron, the court found that the CBC had committed a fault because a report gave incomplete information and resembled more a “settling of accounts” than an unbiased account.

In Canadian common law provinces, were truth is a complete defense, the plaintiff gets a head start because the law presumes that the words are false, but a defendant who can prove that they are true will be exonerated.

Note that believing that a statement was true is not a defence. Those who publish statements will be held responsible for them.

Also note that minor errors will not falsify a statement. Rather, the court will look at the totality of what was said, to determine if it is substantially true.

What is "consent"?

If the defendant has proven that the plaintiff has earlier consented to the posting of the words, then the defendant will be exonerated.

There are no formal waivers that need to be signed, since consent can be implicit. This would of course become a matter of proof. If you get consent in writing, hang on to that piece of paper!

Of course the usual legal exceptions apply here: consent will not be valid if it is obtained by fraud, duress or coercion.

What is "absolute privilege"?

"Absolute privilege" is a very broad and powerful defence to defamation. It relates to various kinds of official communications, such as talks between high public officials, speeches in Parliament, and any communications exchanged during court cases by any participant. To qualify for absolute privilege, the communication must have been made in the context of the official's function.

What is "qualified privilege"?

"Qualified privilege" applies when greater harm would come from the restriction of free speech than from the damages suffered by the plaintiff. Note that this defence can apply even when the words are clearly false and defamatory.

There are no simple rules as to the scope of this defence. Qualified privilege arises when social policy calls for us to protect and encourage certain types of communications. The law in this matter is neither well settled nor clear. Readers wishing a more thorough discussion should refer to the books listed in the "Resources" section, below, or should consult a lawyer familiar with this area of law.

A defence of qualified privilege is less likely to succeed where:

The accusations pertain to a very serious matter, and the harm to the plaintiff outweighs the public interest in receiving the communication;
The information was not verified, and the plaintiff did not have a chance to respond to the allegations before they were published;
The tone of the publication was more sensational than restrained and moderate;

A defence of qualified privilege is more likely to succeed where:

The communications were made to protect the defendant's or another person's property or safety;
The communications were made to protect community interest, or the public.

These factors are by no means exhaustive, and both defendants and plaintiffs will need to argue the specifics of their situation.

Also note that to be able to use this defence, the defendant cannot have acted with malice. Malice may be established by showing that the defendant knew the statement was false or acted in reckless disregard of whether the statement was true or false. If the plaintiff can prove that the words were published with malice, this defence will not apply.

Finally, plaintiffs may also argue that the privilege should not apply in their case because the information was communicated to a greater number of people than required, e.g., a website which is available to all members of the public, and not just to a particular group of people.

What is "fair comment"?

"Fair comment" applies to statements of opinion, as opposed to fact. This defence is based on the fundamental right of free speech, and in particular, the right of everyone to express their opinion.

The "fair comment" defence is limited to matters of public interest, and does not apply if the comment was made with malice. The statement must be recognizable as a comment or opinion and cannot be a factual statement. It must however be based on facts and the comment must be one that could have been honestly expressed from these facts. (WIC Radio Ltd. v. Simpson, 2008 SCC 40) The “fair comment” defence will have little chance of success if there are no facts to support the comment.

What is "innocent dissemination"?

As a general rule, all those who are responsible for publication of a defamatory statement can be held liable for it. This could include the owner of the website, the people who edit it, and those who author the content. However, those who only participate in a purely mechanical way in the distribution may be exempt from being sued. This could include an Internet Service Provider who does not know of the material that is being published through its service. Innocent disseminators will not be liable provided they were not negligent in not knowing the material contained a libel.

In Canada, the defence of innocent dissemination in relation to Internet postings has, to date, not been well developed. Other countries like the United States and the United Kingdom have passed legislation in order to address the position of ISPs in Internet defamation cases. In the U.S., s. 230 of the Communications Decency Act has been interpreted very broadly by the courts so as to protect ISPs from incurring any liability in regard to material taken from other sources which is carried on their services. In the U.K, the Defamation Act, 1996, helped to clarify the defence of innocent dissemination for ISPs

For a defendant to succeed using the defence of innocent dissemination, he must prove that he had no knowledge that the publication contained defamatory matter.

If the defence succeeds, plaintiffs will not be awarded any damages from the ISP who posted the defamatory statements.

What is the responsible journalism defence?

The responsible journalism defence was only recently confirmed in Canada by the Ontario Court of Appeal (Cusson c. Quan, 2007 CanLII 771 (ONCA)). For this defence to succeed, a journalist or “media defendant” must show that reasonable steps were taken to ensure the fairness and veracity of the published content. Like the “fair comment” defence, the information must be of public interest. What are considered “reasonable steps” will vary with circumstances. For example, if the allegations are fairly serious, the defendant will need to show that more thorough research and fact checking was done than for a fairly benign allegation. The Court of Appeal adopted a list of 10 factors articulated in the United Kingdom by the House of Lords Reynolds v. Times Newspapers Ltd., [2001] 2 A.C. 127 that may be considered in ascertaining whether or not a defendant took “reasonable steps” to ensure the fairness and the veracity of the report:

The seriousness of the allegation. The more serious the charge, the more the public is misinformed and the individual harmed, if the allegation is not true.
The nature of the information, and the extent to which the subject matter is a matter of public concern.
The source of the information. Some informants have no direct knowledge of the events. Some have their own axes to grind, or are being paid for their stories.
The steps taken to verify the information.
The status of the information. The allegation may have already been the subject of an investigation which commands respect.
The urgency of the matter. News is often a perishable commodity.
Whether comment was sought from the plaintiff. He may have information others do not possess or have not disclosed. An approach to the plaintiff will not always be necessary.
Whether the article contained the gist of the plaintiff's side of the story.
The tone of the article. A newspaper can raise queries or call for an investigation. It need not adopt allegations as statements of fact.
The circumstances of the publication, including the timing.

This list is not exhaustive and the court can consider other factors.

It should be noted that the decision to admit this defence by the Ontario Court of Appeal is presently on appeal at the Supreme Court and that availability of this defence could change in the upcoming months.

Does the responsible journalism defense apply to non-journalist?

Being fairly new, whether the responsible journalism defense applies to blogs, podcast or other modes of dissemination not traditionally considered as journalism remains uncertain. In Cusson v. Quan, the Court only referred to “media defendants” leading us to believe that anyone who posts a text or a podcast on the internet in the public interest should be able to invoke this defense.

Are there time limitations that apply to defamation actions?

Time limitations for bringing a defamation lawsuit vary depending on the jurisdiction, i.e., in what country or province the case goes to trial. They can be very short, and may involve more than one relevant deadline. In Ontario, the general civil suit limitation period is two years from the day that the damage was discovered by the plaintiff. There is a presumption that the plaintiff was made aware of the damage on the day it first occurred so it is necessary for the plaintiff to prove otherwise in Court. The time limitation can however be shorter if prescribed by specific statutes. For example, shorter time limitations are prescribed for defamation lawsuits by the Libel and Slander Act. (See “What are the notice requirements and limitation periods specific to defamation actions?”, bellow)

At this time, it is not clear how these deadlines will apply in the online world.

What are the notice requirements and limitation periods specific to defamation actions?

Plaintiffs seeking to sue for being defamed must follow strict notice requirements and limitation periods. In Ontario (and many other jurisdictions), there are two deadlines to keep in mind.

Under the Ontario Libel and Slander Act, a plaintiff must first send a notice in writing specifying the matter complained of. This notice must be sent to each person that is to be sued. No special legal documents need to be used, as a letter explaining specifically what the complaint is about will suffice. It is important that the notice be sent within the time allowed by law. If this is not done in time, the plaintiff will lose his right to sue.

In Ontario, the notice must be sent within six weeks after the alleged act of libel has come to the plaintiff's knowledge. If the defendant is an individual, the notice must be delivered personally to him or her. If the defendant is a corporation, the notice must be delivered to an adult at the corporation's chief office.
The Act also sets a deadline for the plaintiff to be able to sue, even if he sends the notice on time. The plaintiff must begin the lawsuit within three months after the libel has come to his knowledge.

How do these deadlines apply to statements posted on the Internet?

It is still unclear how these deadlines will apply to Internet postings. The Act specifically applies to "broadcasts from a station in Ontario" (section 7). However, it is not yet clear whether an Internet posting is a "broadcast".

In one case (Bahlieda v. Santa, 2003 CanLII 12856 (ON S.C.)), the Ontario Superior court, on a motion for summary judgment, said that placing material on a website constitutes broadcasting within the meaning of the Act, and therefore the short time limits apply.

On appeal this decision was overturned (Bahlieda v. Santa, 2003 CanLII 2883 (ON C.A.)). However, the Court of Appeal did not specifically reject the lower court's reasons. Rather, it said that the question was too important and complex to be dealt with in a summary judgment, and so it sent the matter back to trial.

The Court of Appeal was interested in having a full debate on such issues as deciding whether internet publications are a "broadcast" within the meaning of the legislation, whether the word "dissemination" in the Act's definition of "broadcasting" can properly apply to information distributed by the Internet, and whether subsequent viewing of a web page by third parties amounts to a "republication" of the material (which would reset the clock on the time limits).

In a more recent decision (Janssen-Ortho Inc. v. Amgen Canada Inc., 2005 CanLII 19660 (ON C.A.)) the Ontario Court of Appeal considered that it is possible to infer that internet dissemination is a broadcast in Ontario if it was also a radio broadcast that happened in Ontario.

Until these issues are clarified by a court decision or legislation, the law will remain unclear as to how the current limitation periods apply to internet postings.

Outstanding issues include:

The Act's short time deadlines apply to "broadcasts from a station in Ontario", but it is not yet clear that they apply to an Internet website. While the definition of "broadcast" is broad, it may not include an Internet website because this does not mesh well with the language of the law as a whole.
It is not clear what a "station" is in the context of the Internet.
It is not clear that a website "disseminates" information, i.e., actively sends information, or whether it only passively waits for web surfers to come by.
The Act contains provisions specific to newspapers and broadcasting stations that require the publication or provision upon request of the names and addresses of owners/operators in order for them to take advantage of these short limitation periods. It is possible that these will apply in the online context as well.
It is not clear whether there is a new publication every time someone accesses (downloads) the website. If there is, the time limitations would begin anew whenever this happens. Others argue that there is only one cause of action and the limitation period will start running when the statement is first posted on the website.

Note that even if the plaintiff succeeds in these arguments, he still cannot wait indefinitely. He will have to begin his lawsuit within two years of discovering the defamation because of the general limitation period for civil law suits in Ontario.

Can I be sued for defamation in another country because of comments I post on the Internet?

The global reach of the Internet has thrown a complicated curveball at the legal world on the question of jurisdiction: when should a court hear a case involving allegedly wrongful activity involving parties in multiple jurisdictions? Someone in Ontario can post a comment about an Irishman (with a considerable reputation in Spain) on a website operated by an American, but hosted by an English ISP, and those comments can be read by an Australian while on business in Japan. If the comments are defamatory, can the subject of the comments sue, and if so, where?

Courts have been moving toward a "targeting" test to determine whether a court should assert jurisdiction over any given case. This test considers whether the publication in question is directed towards the territory being asked to assert jurisdiction. In one of the best known applications of that test, Dow Jones & Company Inc v Gutnick, [ 2002] H.C.A. 56, the High Court of Australia ruled that defamatory statements originating in their paper publication, Barrons, but available online at Dow Jones' website, amounted to a wrong actionable in Australia. The Court noted [at para. 181] that "A publisher, particularly one carrying on the business of publishing, does not act to put matter on the Internet in order for it to reach a small target. It is its ubiquity which is one of the main attractions to users of it."

More recently, in Bangoura v. Washington Post, 2004 CanLII 26633 (ON S.C.), an Ontario Court had moved beyond the "targeting" test, to consider the case in which the subject of a publication travels from jurisdiction to jurisdiction. In that case, the Court observed that a newspaper "should have reasonably foreseen that the story would follow the plaintiff wherever he resided." Anyone seeking a remedy for defamation in such a context should consider which court has the power to enforce the court order. On appeal, however, the Court of Appeal rejected that approach, returning to a more targeted approach to assessing jurisdiction. The Court of Appeal expressly disapproved of the "following" approach adopted at trial, stating that it "cannot agree . . . that the appellants 'should have reasonably foreseen that the story would follow the plaintiff wherever he resided.' It was not reasonably foreseeable in January 1997 that Mr. Bangoura would end up as a resident of Ontario three years later. To hold otherwise would mean that a defendant could be sued almost anywhere in the world based upon where a plaintiff may decide to establish his or her residence long after the publication of the defamation." See Bangoura v. Washington Post, 2005 CanLII 32906 (ON C.A.).

These cases emphasize the care that one must take in posting comments on the Internet.

What are "SLAPPs"?

"SLAPP" stands for "Strategic Lawsuits Against Public Participation". SLAPPs are legal actions (usually defamation actions) launched for the primary purpose of shutting down criticism, and without a strong cause of action. The plaintiff's goal in a SLAPP is not to win the lawsuit, but is rather to silence a critic by instilling fear of large legal costs and the spectre of large damage awards. Despite their right to free speech, critics may be frightened into silence B e.g., taking down websites or comments made online - if they are threatened with a defamation-based SLAPP.

What are "CyberSLAPPs"?

CyberSLAPPs are simply SLAPPs launched in the online world. Aside from the above issues, they also raise issues relating to anonymity. Internet users are not easily identifiable (as seen in the recent recording industry file sharing cases). Organizations wishing to discover the identities of their online critics may therefore attempt to launch defamation SLAPPs whose only goal is to obtain the other party's name. This is of great concern since the linking of an Internet identifier (such as an e-mail address) to a particular person will mean that every message that person has ever posted under that identifier becomes known to have originated from them. This can be a problem as many lawful forms of speech, if revealed, can cause harm to the poster. Examples include people seeking advice on marital problems, teenage problems, depression, medical or financial issues. In such cases, however, the court can order that identifying information provided to plaintiffs be kept confidential.

How are governments reacting to SLAPPs?

There are already extensive laws in the United States and other countries to try to prevent SLAPPs. In Canada, Quebec is presently the only province with an anti-SLAPP law. It is highly probable that laws will soon be adopted in the rest of Canada.

In British Columbia a law was adopted in 2001 but then later repealed in the same year when a different government was elected. During its short life span, this law permitted people to make an application for summary dismissal of cases on the basis that they were SLAPPs. If the case was deemed to be a SLAPP, the Court could award reasonable costs and expenses as well as punitive damages. It also permitted the court, if the alleged defamatory statement was deemed to be “public participation”, to order that a security be paid by the plaintiff for expenses and punitive or exemplary damages.

The Quebec law adopted in June 2009 modifies its Code of Civil Procedure to better address SLAPPs. The modifications to the Code permit a summary dismissal of cases deemed to be SLAPPs. Like the repealed British Columbia law, the Quebec law permits the court to ask the plaintiff for security and to award costs and expenses as well as punitive damages. Also, once the defendant makes a prima facie case that the lawsuit is abusive, the burden shifts to the plaintiff to prove that the case is legitimate. If a SLAPP is suspected, the Court can also set specific rules for the proceedings so as reduce the effects of the suspected SLAPP on the defendant. The object of this law is to impose costs and sanctions on plaintiffs who would seek to use the courts to silence critics.

In December 2008, a private member’s Bill was introduced in the Ontario Legislative Assembly and remains on its first reading. Bill 138, the Protection of Public Participation Act is essentially the same as the repealed B.C. law.

Today's Iran tragedy is not because of theocratic regime in Iran is playing game with Iranian dissidents, it is because there are ancient fossils who are playing games with Iranian dissidents, and they are misleading course of action against the establishment in Iran. These ancient fossils were victims of Marxist-Islamist Utopia in 1979, and they fled Iran, and took refuge in Western nations. Eventually, the regime in Iran compensated them for their pain and suffering in return these individuals would act as eyes and ears of the regime in Iran. Introduction:
Dr. Carter McNamara defined strategic planning as a way of determining “where an organization is going over the next year or more, how it's going to get there and how it'll know if it got there or not. The focus of a strategic plan is usually on the entire organization.”1 There were several models for developing a strategic planning for an organization which is correlated to the organization's nature; such as, “leadership, culture of the organization, complexity of the organization's environment, size of the organization, expertise of planners.”2 Moreover, there were several models of strategic planning like “goals-based, issues-based, organic, scenario. Goals-based planning is probably the most common and starts with focus on the organization's mission (and vision and/or values), goals to work toward the mission, strategies to achieve the goals, and action planning (who will do what and by when). Issues-based strategic planning often starts by examining issues facing the organization, strategies to address those issues, and action plans. Organic strategic planning might start by articulating the organization's vision and values and then action plans to achieve the vision while adhering to those values. Some planners prefer a particular approach to planning. Some plans are scoped to one year, many to three years, and some to five to ten years into the future. Some plans include only top-level information and no action plans.”3 The Justice for All's strategic model was goals-based planning which had a mission statement, and goals were geared toward the mission statement of the Justice for All. The aim of this paper is to discuss situation analysis of the Justice for All, who were key stakeholders, developed strategies for achieving each objective, implementing and action plan, staffing and budget, and how to monitor the project.
Situation Analysis:
This portion of the paper was discussing situation analysis of the Justice for All by relying on formula of SWOC {Strength, Weakness, Opportunity, and Challenge} in order to conduct environmental scanning of the Justice for All. The “SWOC analysis clarifies the nature of these tensions by juxtaposing two fundamental dimensions of existence-good and bad-as well as two temporal dimensions-present and future. A SWOC analysis in conjunction with an understanding of stakeholders, key success factors, and distinctive competencies clarifies the organizational tensions that arise when trends and events juxtapose concerns for equity, productivity, preservation, and change.”4
Strength:
The Justice for All was able to create public awareness with regard to human rights violation in Iran by using YouTube, and Blog systems from 2006 to 2009.
The Justice for All published several books that how Canadian Government and the regime in Iran were involved in economic trades from 2006 to 2009.
Drafted a manifesto in order to envision a bright and prosperous future for Iran under concept of “justice”.
Weakness:
There was a problem with recruiting members for the Justice for All in the province of British Columbia because individuals were lacking vision for emancipation of Iran.
There was a problem with registering the Justice for All as a non-profit organization in the B.C., so that the Justice for All would be recognized by the Government of Canada as one legitimate organization because the Justice for All did not have four members in the province of B.C. Consequently, the Justice for All was unable to apply effective pressure on the Government of Canada that it would comply the Government of Canada and the regime in Iran to reduce degree of economic, as well as, political relations.
There were different political factions that they were divided over past grievances which were causing them not to focus on immediate task at hand as they were arguing with each other over past issues.
Opportunity:
Working toward one book which was illustrating how the Government of Canada was allowing the regime in Iran to have investments in Canada while those investments were contrary to criminal code of Canada.

The Justice for All was preparing evidences so that it would submit those evidences to the Transparency International Organization that how the Government of Canada was allowing the regime in Iran to have investments in Canada while those investments in Canada were depriving Iranians from basic necessity of life.
Challenge:
To identify all assets of the clerics of Iran in Canada.
The Government of Canada had a policy of Alternative Service Delivery; such as, Build-Own-Operate-Transfer. In this case, a private sector would build a project, and would manage it for a certain time frame, and eventually this project's ownership would be transferred to the Government of Canada.5 It would be likely that the Government of Canada would follow the above suit in order to conceal assets of the theocratic regime in Canada.
Working toward unity among different political factions by providing examples that division among different factions was providing opportunity to the regime in Iran to last longer. Particularly over issue of 1953 Coup in Iran.
The mass media was not interested to report about assets of the clerics in Canada.

Key Stakeholders:
This portion of the paper was discussing concept of key stakeholders. Four categories of stakeholders result: players, who have both an interest and significant power; subject, who have an interest but little power; context setters, who have power but little direct interest; and members of the crowd, who are stakeholders with little interest or power.”7 The “stakeholder analysis are critical because the key success in the public and nonprofit sectors-and the private sector too for that matter-is the satisfaction of key stakeholders. If an organization does not know who its stakeholders are, what criteria they use to judge the organization, and how the organization is performing against those criteria, there is little likelihood that the organization will know what it should do to satisfy those stakeholders.”8 The idea was to identify certain individuals that how supportive these individuals were with the Justice for All's mission statement.9
1.The Government of Canada was supportive of the regime in Iran because the Government of Canada was making financial gain from the clerics' investments in Canada; such as, creating jobs in Canada.
2.The Government of Canada was not supportive of the Justice for All, as a matter of fact, the Government of Canada would explore venues to block the Justice for All to identify assets of the clerics in Canada.
3.The regime in Iran was extremely dangerous, and would pose danger to safety and security of the Justice for All. Also, it would be impossible to open any channel of dialogue with some elements of the regime in Iran in order to expose the assets of the mullahs in Canada.
4.If the Office of the Information Commissioner of Canada would follow its mandate and would assist the Justice for All to identify assets of the mullahs in Canada, the Justice for All would be able to reduce degree of economic relation between the Government of Canada and the regime in Iran.
5.Iranian dissidents were lacking vision for emancipation of Iran due to past grievances; such as, 1953 Coup in Iran. As a result, it would be vital to mediate over past issues, and mobilize Iranians toward one common cause like conforming the Government of Canad to disclose all assets of the mullahs in Canada, and the Government of Canada to stop its relation with the regime in Iran. Plus, the Government of Canada would freeze all the assets of the mullahs in Canada, and would not allow the mullahs to make Canada as an economic nest.
Strategic Planning for Achieving Each Objectives:
This portion of the paper was discussing concept of strategic planning which “is to develop a clear and succinct description of what the organization should look like as it successfully implements its strategies, achieve its full potential, and creates significant public value,”10 and “mandates, mission, and values indicate the public value the organization will create and provide the social justification and legitimacy on which the organization's existence depends.”11 The mandate define preexisting of “an organization can define its mission and values, it must know exactly what it is formally and informally required to do by external authorities.” The mission statement “clarifies an organization's purpose, or why it should be doing what it does; vision clarifies what it should look like, and how it should be have as it fulfills its mission.”12 The value statement would be defining an organization's philosophy and culture.13
The Justice for All needed to formulate a “mission statement” which would be appealing to public and would explain to public that why the Justice for All exist, and what it was trying to accomplish. Hence, the Justice for All developed a mission statement that it was “committed to the protection, and enhancement of the quality of life for all members of our community through service function and expressive function that comes from education and from promoting and upholding good political, social and economic standards and practices.”14 The Justice for All would like to reach to public by providing educational programs with regard to human rights violation in Iran. Also, the Justice for All developed a vision value which would define the Justice for All as a “grassroot movement” by empowering vulnerable members of its community, and creating a vibrant and healthy network beyond boundary of Canada by publishing books, articles, researched papers, video clips, films, and requesting from international communities to assist the vulnerable members to overcome their barriers in order to execute justice to those individuals whom are victims of injustice.”15 Last, the Justice for All developed a value statement that the Justice for All was “working with its community by providing proper education in its community about injustice which is taking place in Iran, and with will of Iranian to seek justice in Iran by putting aside political ideologies, past grievances, and focusing on unity among diversity of ideas, belief systems, and backgrounds.”16
The Justice for All goals:
1.Providing public education with regard to human rights violation in Iran.
2.Convincing different Iranian political factions to put aside their past grievances. Particularly over issue of 1953 Coup in Iran.
3. Mobilizing Iranians toward one common goal in order to emancipate Iran from the current establishment in Iran.
Implementing and Action Plan:
This portion of the paper was discussing how to implement an action plan for the Justice for All. The Justice for All needed to create a strategic planning “which can produce significant value-especially in terms of building intellectual, human, social, political, and civic capital-but that is not enough.”17 “The most important outcome that leaders, managers, and planners should aim for in this step is added public value resulting from greater achievement of the organization's goals and heightened stakeholder satisfaction.”18 In addition, “the second subordinate outcome is the development of a clear understanding by implementers of what needs to be done and when, why, and by whom.”19 There was “a third subordinate outcome is the use of a debugging process to identify and fix difficulties that almost inevitably arise as a new solution is put in place.”20 There was a “fourth, successful implementation is also likely to include summative evaluations, to find out whether strategic goals have actually achieved once strategies are fully implemented.”21 Last, there was “a fifth subordinate desired outcome is retention of important features of the adopted strategies and plans. As situations change and different actors become involved, implementation can become a kind of moving target.”22
Action Taken:
1.The Justice for All decided to publish one book each year in order to raise awareness about poor human rights record of the regime in Iran. Since 2006, the Justice for All has published one book each year in order to raise awareness about human rights violation in Iran.
2.In 2006, the Justice for All commenced to check archives of CIA and other government agencies' archives to prove that the CIA did not orchestra the 1953 Coup in Iran. In 2008, the Justice for All discovered three CIA documents with regard to the 1953 Coup that the CIA did not have involvement in the 1953 Coup in Iran. The three documents were submitted to Crown Prince Reza Cyrus PAHLAVI Heir to Throne of Iran. Thus, Crown Prince PAHLAVI would weigh how to apply the above CIA documents. In addition, the Justice for All posted the CIA documents on the blog.
3.In 2006, the Justice for All launched an investigation with regard to the clerics' investments in Canada, and it came to attention of the Justice for All that Rafsanjani owned 49% of HWY 407 in province of Ontario. The Justice for All drafted a letter to Right Honorable Stephen HARPER and told him that Rafsanjani was an international terrorist. As a result, Canada was breaking criminal code of Canada 83.03 by allowing Rafsanjani to have investment in Canada. Right Honorable Stephen HARPER did not answer the Justice for All's letter.
4.It would be impossible to ask the Government of Canada to collaborate with the Justice for All. So, the international community would stop the Government of Canada to have economic ties with the regime in Iran.
5.The final, ultimate, goal was total removal of the theology state in Iran by using Karl Marx theory of Proletarian Revolution. The above goal would be difficult to attain because the regime in Iran was able to make investments in Canada and other nations. Therefore, the regime in Iran was bribing the other nations by foreign investments.
Budget and Staffs:
This portion of the paper was discussing budget and staffing of the Justice for All, and the “budget allocations have crucial if not overriding significant for the implementation of strategies and plans. Budgets often represent the most important and consequential policy statements that governments and nonprofit organizations make. Not all strategies and plans have budgetary significance, but enough of them do that public and nonprofit leaders and managers should consider involving themselves deeply in the process of budget making.”23 Furthermore, the budget played a vital role in quality of a project.24 When there would be sufficient budget for a project, project manager would hire specialized staffs to conduct certain tasks in order to make sure the project would be finished on time and within specifications which would meet expectation of stakeholders.25
Budget and Staff of the Justice for All:
1.The Justice for All had $900.00 US budget to publish book each year.
2.Revenue from the books would remain private and confidential.
3.The Justice for All did not pay for office space, phone, Internet, and stationary materials because the Justice for All was a home base.
4.The Justice for All could not have volunteers because it would be difficult to check their backgrounds and making sure they were not part of secret services of Iran or Canada.
5.The Justice for All had insufficient budget to hire professional staffs to investigate or extracting information from the Canadian agency archives. As a result, it was greatly time consuming to extract information from government agencies.
6.The Justice for All was attending University of Victoria to learn skills, and tools with regard to Public Administration in order to be proactive, as well as, effective with regard to implementing the above actions.
Monitoring the Project:
This portion of the paper was discussing how to monitor the project. The last stage of a project was a delivery stage which is required to deliver a project to stakeholders, “includes the two activities: delivering the project product to the customer and redeploying project resources. Delivery of the project might include customer training and transferring documents. Redeployment usually involves releasing project equipment/materials to other projects and finding new assignments for new team members.”26

Delivery Stage:
1.The Justice for All was involved in public education by publishing books with regard to human rights violation in Iran, and how the Government of Canada had amicable economic relation with the regime in Iran.
2.Posting materials about human rights violation on YouTube and Blog.
Therefore, the Justice for All was a new organization, and had insufficient budget to hire professional staffs to carry certain tasks. Also, it was too risky to rely on volunteers to do the job because secret services from Iran were not kind upon individual like the Justice for All. As it was relying on current courses at the University of Victoria to learn and develop skills and knowledge in order to be proactive on current affairs of Canada and Iran. In addition, the Justice for All developed its mission statement in summer of 2009, and it was working hard to reach to public, and educate public about human rights violation in Iran.
The main goal of the Justice for All was total removal of the theology state in Iran by applying Karl Marx theory of Proletarian Revolution. Thus, the Justice for All needed to apply economic pressure on the regime in Iran so Iranians would be inspired to the change the regime in Iran. It would be a difficult task to do since other nations were making financial gains from the regime in Iran.

Yesterday, the Senate Committee on Health, Education, Labor and Pensions held a hearing to determine how health care reform could impact women across North Carolina and the nation. As I have stated before, I agree that we need health care reform so that Americans, regardless of whether they are male or female, can access affordable coverage. That is why I joined my colleague Senator Tom Coburn earlier this year to introduce a reform bill called the Patients’ Choice Act.

Rather than creating a new government-run plan, our bill aims to rein in costs by emphasizing prevention and wellness, rather than only treating people when they are sick. Our bill also addresses affordability by ending the “cherry picking” that allows insurance companies to deny coverage for pre-existing conditions. Better yet, our bill doesn’t increase the deficit or increase taxes.

The health care reform bill the Senate Finance Committee passed this week fails to address malpractice reform and any discussion about affordable health care for women must include medical malpractice reform. The Congressional Budget Office released an analysis just last week that shows that medical liability reform could save taxpayers roughly $54 billion over the next 10 years. Equally as important, comprehensive medical liability reform would reduce total national health care spending by about 0.5 percent – or about $11 billion in 2009 alone.

For example, if we care about making sure women have access to OB/GYNs, we cannot ignore the fact that high malpractice insurance is driving doctors out of this specialty and, even worse, closing practices. This issue seems to be the 800 pound gorilla in the room when it comes to access to affordable health care for women. Additionally, we need to make the insurance marketplace more competitive by allowing individuals to purchase insurance across state lines. This would ensure that women would be able to pick a coverage option that fits their specific needs, even if those needs aren’t met by plans offered in their home states. We cannot effectively reform health care without addressing medical malpractice reform.

No one disagrees that reform is necessary, but I will continue to oppose legislation that has been rushed through for the sake of passing something at the expense of quality reform, and I will push for reform that actually reduces cost in addition to expanding health care coverage. We need to get this right so that our children and grandchildren do not have to spend their lifetimes correcting our mistakes and paying off the debt we left them.

Also this week, the Senate passed legislation I cosponsored which authorizes advanced appropriations for VA medical care. The bill, which is now on its way to the President, funds the Veterans Health Administration (VHA) in two-year cycles through advance appropriations. This gives VHA the ability to plan its budget one-year ahead of the regular federal funding process. Currently, the budget for VHA is subject to delay, which hinders the ability to plan and provide quality care to our veterans. In a time of war and an aging veteran population, we have an obligation to ensure that veterans can get the health care they need when they need it.

I am also excited to announced that yesterday, the Department of Interior awarded $487,000 to the Cape Lookout Lighthouse for repairs that will allow the National Park Service to re-open the lighthouse to the public in 2010. Standing 163 feet tall, the lighthouse was first lit on November 1, 1859, making this year its 150th anniversary. Thought it has been closed to the public since the spring of 2008, the lighthouse is an important part of our state’s heritage and to this day warns ships of the location of the Cape Lookout Shoals. These much needed repairs will allow the lighthouse to re-open so that future generations of Americans will be able to enjoy this national treasure and fully appreciate its historical significance to our state.

A developer in Colorado is trying to draw water from the Green River and pipe it to Colorado’s Front Range.

This project has broad repercussions for our entire state. That’s why I stepped in to guarantee Sweetwater County communities have a voice during this debate. Sweetwater County, Rock Springs, Green River and the Sweetwater County Conservation District now have cooperating agency status with the U.S. Army Corps of Engineers. The status gives the Sweetwater County community a chance to share their expertise with the Corps of Engineers as it begins drafting its recommendation.

Protecting the current and future interests of Wyoming is paramount. We must work to ensure a plentiful future water supply for Wyoming.

WASHINGTON, D.C. -- The non-partisan Congressional Budget Office (CBO) predicts the U.S. fossil fuel industry will suffer significant job losses if the Waxman-Markey climate bill is signed into law.

Director of the CBO, Dr. Douglas Elmendorf, said the fossil fuel sector would mirror the massive job losses experienced by the manufacturing industry since the 1970s.

The startling admission was in response to questioning by Senator John Barrasso (R-Wyo.). Elmendorf was testifying before the Energy and Public Resources Committee hearing Wednesday.

WASHINGTON, D.C. – U.S. Senators Mike Enzi and John Barrasso, both R-Wyo., put their weight behind an amendment today that would change Senate rules to increase transparency in the halls of Congress.

The amendment, which is identical to a stand-alone resolution the members cosponsored this week, requires every piece of legislation in the Senate to be available to the public and provide a full cost analysis by the Congressional Budget Office three days before consideration by any subcommittee or committee of the Senate or on the floor of the Senate. Unfortunately, the Democratic leadership used a procedural motion to block consideration of the amendment on the Commerce, Justice, Science Appropriations bill currently being debated in the Senate.

Barrasso is fighting the Administration’s efforts to fund a climate change center at the Central Intelligence Agency (CIA) in the Fiscal Year 2010 Defense Appropriations bill.

Senator John Barrasso, a conservative freshman Republican from Wyoming, said on Tuesday that he would try to stop the Central Intelligence Agency from opening a new climate change center by choking off its funding.

“The C.I.A. is responsible for gathering foreign intelligence information for the United States,” Mr. Barrasso said in announcing an amendment to a 2010 spending bill to block any money being spent by the agency on the new office. “I don’t believe creating a center on climate change is going to prevent terrorist attacks.”

Recently, I received the below propaganda from the Conservative Party of Canada “for too long, criminals have been exploiting a loophole in Canada's legal system. Many criminals that serve time before their trials have been getting double and triple credit against their time served. Clever criminals figured this out and extended their pretrial holding for more credit once they were found guilty. This puts criminals back on our streets faster. Now the Conservative government is taking action to close that loophole. We are introducing new legislation to end this unfair practice, making criminals serve their full sentences. Double credit for time served has been the norm in the past, but we are acting to change that for the future. Canadian families can count on the Conservative government to end double credit for time served.” However, according Criminal Code of Canada Proceedings in criminal and penal matters “11 b) to be tried within reasonable time, and 11 d) to be presumed innocent until proven guilty according to law in a fair and public hearing by an independent and impartial tribunal.”1 Furthermore, Crown Attorney are causing delay on cases during pre-trials due to insufficient evidences against accused person as the Crown Attorney would request from police officers to carry further investigation.

Therefore, the accused persons have nothing to do with delay or anything, and with regard to double credit which is due to 11 d).

The real issue would be when these politicians would stop giving themselves pay hike, and would start investing public's money in people; such as, educational programs, rehab programs, protecting privacy of accused persons, and many more programs in order to make sure that individuals in conflict with law would reintegrate in mainstream society.

According to Conservative Party of Canada's philosophy, guilty until proven innocent, and very soon, it would introduce some kind of legislation to strap due process. After all these individuals will not go hungry, and they have police connection.

It’s been a busy month in the Senate. The conclusion of debate in the Senate Finance Committee means another important step towards providing access to affordable insurance for millions of Americans. We are closer than ever to health insurance reform and I am urging my colleagues to bring to the floor of the Senate strong legislation that will provide quality, affordable access to health insurance for all New Mexicans.

In order to help the one in four New Mexicans who are uninsured and the thousands more who are underinsured, I believe health insurance reform must include:

• A public option for uninsured families and small business employees to get coverage and to keep insurance companies honest
• Preventive care to change our current system from a sick care system to a health care system
• Increased access to health care for rural communities, veterans and Indian country
• Help for small businesses to cut through red tape and work together to cut costs

I’m proud of what my colleagues in the Senate have been able to accomplish so far, but there is still much work ahead.

Fresh Voices in Unison for Health Insurance Reform

Over the past two weeks, my fellow freshman senators and I came together on the Senate floor to sound a call for swift health insurance reform that will contain costs and improve care for all Americans. We took a look at the high price of inaction — more New Mexicans without insurance, more New Mexicans bankrupt from hospital bills, and more hidden taxes for us all to pay for the uninsured. The status quo is not an option. We cannot afford to go any longer without meaningful reform.

In New Mexico, we have an epidemic of preventable diseases and a real need for an emphasis on preventive care. In my second speech, I called for reform that makes clinical services like mammograms and colonoscopies and cholesterol screenings more available and provides incentives for adopting healthy lifestyles. Preventive care will not only cut costs, it will ensure the health of future generations.

Finding a "Do It All", "Do It Right" Energy & Climate Bill

This week I called on the Senate to pass legislation that will put our nation on a path towards energy independence. At the unveiling of the Clean Energy Jobs and American Power Act, I spoke of the urgency that we change our course from an addiction to foreign oil to a clean energy economy.

The best way to make this transition is through a "Do It All", "Do It Right" energy approach that includes renewable energy, natural gas, enhanced domestic production, safe nuclear power, real clean coal technology and energy efficiency. As part of that approach, I believe that New Mexico and the West can lead the way.

This week, I attended a Veterans Affairs’ Committee hearing on veterans who have been exposed to toxic substances, such as water contamination at Camp Lejeune in North Carolina. Because of Camp Lejeune’s location in our state, this issue is very personal to me.

Thousands of Navy and Marine veterans and their families who lived on Camp Lejeune have contracted various forms of cancer and other diseases believed to be attributable to their service at the base before it was designated a Superfund site in 1988. Studies are ongoing, but these veterans and their families have waited more than two decades to get answers about what is making them sick.

That’s why I have introduced the Caring for Camp Lejeune Veterans Act of 2009. My legislation would allow veterans and their family members stationed at Camp Lejeune while the water was contaminated to get medical care from the VA. These veterans and their families deserve closure to this tragic situation, and Thursday’s hearing was a step in that direction. I believe we must do what is right by funding the government’s scientific studies of this issue and caring for these patriots and their families.

Also this week, I introduced two pieces of legislation related to lands in Western North Carolina. The Pisgah National Forest Boundary Adjustment Act would authorize the U.S. Forest Service to acquire twenty-three acres of land near Catawba Falls and the Pisgah National Forest and allow the Forest Service to open a public trail to Catawba Falls. The second bill, The Blue Ridge Parkway and Town of Blowing Rock Land Exchange Act, would allow the town of Blowing Rock to acquire permanent ownership of its water supply reservoir and give the Parkway a 192-acre buffer tract from the town.

North Carolina’s public lands are some of our state’s greatest assets. The Pisgah National Forest provides tremendous environmental and economic benefits to McDowell County, and providing trail access to Catawba Falls will drive more tourists to the area. Also, ensuring the town of Blowing Rock will continue to have access to their water supply is important and gives a boost to the overall economy. Both of these pieces of legislation will allow North Carolinians to enjoy the beauty of our state.

Next week, the Senate will take up the Commerce, Justice, and Science Appropriations bill . Also, the Senate Finance Committee will have their final vote on the health care reform bill on Tuesday.

This week, Senator Kay Hagan (D-NC) and I introduced the Lumbee Recognition Act. This bill would provide federal recognition to the Lumbee Tribe of North Carolina. I am proud to introduce this legislation to help the Lumbee Tribe receive the federal recognition they deserve. Currently, this can only happen through an act of Congress. I hope that the Senate will fulfill its commitment to achieve fairness and justice for the Lumbees.

Also this week, during their consideration of health care legislation, the Senate Finance Committee voted against creating a government option twice (one vote was 15-8 and the other was 13-10). As I’ve written here before, the need for health care reform is clear, but the government option is not the way to go. It is more important to get this right so that our children and grandchildren do not have to spend a lifetime correcting our mistakes, than to rush a bill through.

This weekend, I will be visiting with 100 World War II veterans from North Carolina who are traveling to Washington on Saturday to visit the World War II Memorial on the National Mall. Honor Flight was created to honor America’s veterans by flying them—free of charge—to Washington, DC, to visit the national memorials built in their honor. America’s World War II veterans served our country with honor and they deserve the opportunity to see the national memorial that has been erected in memory of their service. I look forward to meeting with these veterans on Saturday.

Next week, the Senate Veterans’ Affairs Committee will hold a hearing on potential exposure issues within the Department of Defense and VA. At this hearing, I intend to continue to press for a resolution to the Camp Lejeune water contamination issue. Former Marines, their families, and former employees at Camp Lejeune have waited far too long for answers.

Dear Friends,

We teach our children to never sign a blank check or blank contract. It’s an important lesson. The consequences of signing anything without all of the details can have broad repercussions.

Many in Congress are betting we didn’t learn this lesson. Senator Barbara Boxer and Senator John Kerry recently introduced a massive tax grab disguised as a climate change bill. The bill is full of fill-in-the-blanks and empty brackets. These empty brackets conceal hidden taxes that will cost thousands of jobs.

One thing is certain: American families cannot afford this massive tax gamble. American energy means creating American jobs. With unemployment at its highest rate in decades, we need red, white and blue jobs - not just green jobs. I’ll be sure to fight this tax grab every step of the way.

This author made below remarks which makes his credentials as a Central Intelligence Agency officer questionable.

1.This author on prologue section page 1 claimed that in 1978 he was 24 years old young man and was on his way to India, as he had short stop in Iran, Tehran during Marshall laws. This author alleged that “the kamikaze taxi driver who drove me into Tehran from the airport that night taught me my first lesson: Iranians can't drive. The way he swoop and darted between the army patrols, I was convinced he was trying to draw fire. And was it legal to drive down the sidewalk to get around traffic?” Input: This sidewalk needed to be wide enough as well as accessible for a moving vehicle to drive on it because there is a big gap between road and sidewalk, and the author's statement would be impossible to do so since there is no such a sidewalk in Iran.
2.This author on page 55 alleged that “in October 2000, Ayatollah Khamenei, Ayatollah Khomeini's successor as supreme leader-the only real executive power in Iran-made it clear what the victory in Lebanon meant for Iran. It was during a secret address to Iran's National Security Council. After the usual long preamble, larded with quotations from the Koran, Khamenei put both hands on the conference table.” Input: Since he is an intelligent officer, he is required due to nature of his work to be detail orient, and should know that Khamenei's right hand is immobile. As a result, there are cloud of doubts looming on the book as how truthful is this author with his readers.

This author contradicts himself on major points as follow.

1.This author on page 10 asserted that “and it wasn't as if the Iranian government could not close down the opium dens if it wanted to. Iran is a police state. Every day I drove around Tehran, or walked around the streets and bazaars, I was stopped and my papers checked.” On page 77 this author claimed that “Iran is not a totalitarian state run by “Islamofascists” who believe they're in some quixotic war with the West.” Input: Police state and totalitarian state shared same meaning as a state controls every fabric of a society, as this author experienced in Iran under rule of the mullah in Iran.
2.This author on page 207 claimed that “since 9/11, without any evidence, these people have tried to make the case that Muslims intend to infiltrate the United States, bring down from inside, and convert us to Islam.” On page 230-231 this author was talking with Muhammad British-Pakistani born who made a remark about 7/7 which was the way to go and “accept Allah's law,” he said. “End of story. Accept Allah's law and I think you'll have a peaceful life.” In other words, we either convert to Islam or die.” Input: There is a reality that Muslims are planning to convert Western nations to Islam or they have to die.

Author's theory frame work for the cleric regime in Iran:

1.This author was working on theory of green belt or green crescent which was orchestra by former democrat president Jimmy Carter to contain communism in the region. As this author claimed that the cleric regime in Iran has infiltrated in Afghanistan, Lebanon, Palestine and Iraq and the regime in Iran was in charge of the situation in the region. Also, Turkey was under spill of the regime too but not as strongly as other region. As a result, the cleric regime in Iran is a superpower. This author lacked understanding the term superpower which means a state is in leading position in the international system and has ability to influence on international events. Current regime in Iran is not able to control international event, and has been struggling about its nuclear programs. The regime in Iran is not a great power either which would have economic, military, diplomatic and cultural strength. The current regime in Iran is a rouge state, which is an authoritarian regime, absent of human rights, and seeking weapon of mass destruction.
2.This author was claiming that the regime in Iran is no longer relying on terrorism to advance its interest. However, the cleric regime has been targeting Iranian dissidents and have been murdering them around the world.
3.This author on page 15 claimed that the US do not understand the regime in Iran because of Iranian dissidents are lobbying the White House and the White House does not have clear understanding of Iran. According to the record, so far element of the cleric regime on individual base or as a council like National Iranian American Council had opportunity to meet senior staffs and elected politicians, and to mislead the White House and not Iranian dissidents.
4.This author is working on fear tactic that price of oil on rise and on page 198 this author says it is in best interest of the US to negotiate with the regime in Iran. However, he does not provide any information or strategy how to negotiate with the regime in Iran.

Author was bias toward Iran:

1.On page 9, this author claimed that there was no moral police officers in Iran. However, the regime has moral police officers who are enforcing Islamic dress code in Iran.
2.On page 104, this author wrote “the Iranians understand perfectly that the only reason we care about that miserable body of water called the Persian Gulf.” Input: This author is hostile toward Iranian identity.
3.This author claimed that during Iran-Iraq War youths were not given keys to paradise and asked to rush at enemy front and die. The key was a symbol of martyrdom. However, the regime gave the youth the keys and told them that these were keys to paradise.

Validity of information:

This author used, on page 143, statics about unemployment rate in Iran, and other data that it was unclear where the numbers were extracted from. Last, he alleged when in 1700's England's warship moved to Persian Gulf, this body of water was called Gulf and not Persian Gulf. The above claim was not reference from any source of information.

The bottom line, this book does not have any kind of academic merit, and it tries to claim that the regime in Iran is a superpower and the US needs to negotiate and accept the regime in Tehran as a power. However, this author's theory lacks understanding proper meaning of political terms that the regime in Iran is a rouge state and not a superpower.

General Political Environment:
Iran has been an Islamic theocratic republic since 1979. The political system is partially
democratic in that the President and some legislative bodies are popularly elected but the ability
of conservative clerics to bar candidates from contesting elections narrows Iranians’ spectrum of
political choice. Much state power rests with conservative-dominated unelected bodies.
A relatively liberal era in Iranian politics ended in February 2004 when conservatives were swept
into power legislative elections. The previous Majlis (legislature) had been dominated by
reformers but a combination of public dissatisfaction with the government and the fact that many
reformers were not allowed to contest the election made a conservative victory virtually inevitable.
Observers were surprised when the hard-line conservative former mayor of Tehran, by Mahmoud
Ahmadinejad’s won the June presidential run-off election against conservative Akbar Hashemi
Rafsanjani. Since assuming office, Ahmadinejad has become known for his populist domestic
agenda and a confrontational stance toward the United States and Israel.
Iran and much of the international community are engaged in a three and a half year impasse with
respect to Iran’s nuclear programme. Iranian officials say that the country wants to master the
nuclear fuel cycle for peaceful purposes but the United States and Israel, among others, fear that
Iran is trying to develop nuclear weapons and want the programme halted.
On December 23, 2006 the United Nations Security Council adopted Resolution 1737 which
imposed limited sanctions against Iran’s nuclear and ballistic missile activities. A more stringent
set of sanctions (UNSC Resolution 1747) was imposed on March 24, 2007.
On May 23, 2007, the International Atomic Energy Agency (IAEA) reported that Iran is continuing
its uranium enrichment activities and, as such, is non-compliant with Resolutions 1737 and 1747.
As a result, pressure for more far-reaching UN sanctions is likely in the near term. In the
meantime, the United States is using unilateral financial restrictions to isolate Iran economically.
Investment Environment:
The much-anticipated Foreign Investment Promotion and Protection Act (FIPPA) was instituted in
2001. The new law allows for easier repatriation of profits, streamlines approval procedures, and
offers protection against nationalization and expropriation. Furthermore, Iran intends to privatize
a number of state-owned telecommunications and oil enterprises in the near future.
Despite these developments, significant levels of corruption and a complex bureaucracy continue
to underline the challenging nature of Iran’s business climate. Iranian courts are governed by
hard-line clerics and remain opaque, corrupt and very powerful.
US restrictions will further complicate the task of doing business in Iran by drastically curtailing
potential sources of financial intermediation. The United States Treasury department already
forbids US citizens and companies from dealing with two Iranian state-owned banks and it has
indicated that more such directives are imminent. As a result, many commercial banks – most of
which have significant US operations – are terminating their Iran business.
Political Violence:
Since the beginning of the nuclear standoff the possibility of a US military strike against Iranian
nuclear facilities has been mooted. However, the risk of a strike is assessed as low owing to the
operational difficulty of the task and Iranian retaliatory capabilities.
There is a significant risk of anti-foreign protests resulting from the nuclear standoff as evidenced
by the pro-nuclear demonstrations which occurred at the British and French Embassies in 2005.
There has been a growing trend of unrest by marginalized ethnic groups across Iran in the past
few years. This has included violent unrest by ethnic Kurds in the Kermanshah and Kordestan
provinces, ethnic Baluchis in southeastern Sistan va Baluchistan province and Iranian Arabs
centred in and around the city of Ahvaz in oil-rich Khuzestan province.

Market Spotlight: 2006 was a solid year for Iran. GDP growth accelerated. This reflected its
expansionary fiscal policy, which was boosted by a series of oil windfalls. The main trust of economic
policy is to reduce social and regional disparities while creating jobs. However, it has failed to tame
inflation. The hydrocarbon sector needs to be upgraded, but investors are nervous about the UN
sanctions and Iran’s rhetoric. Trade with Iran, which has been affected by the U.N. Security Council
Resolution 1737 that was adopted on December 23, 2006, could face tougher economic sanctions
now that Iran has refused to suspend nuclear activities. Iran’s “Money Laundering Bill” (MLB) has
been finalized after US actions against Bank Saderat & Bank Sepah, which have made it difficult to
do transaction in US$ dollars. Iran decided that oil sales should be paid in Euros. Tehran has been
shifting its foreign-held assets out of dollars since 2003 and has found new trade partners. The Oil
Stabilization Fund (OSF) has been used to finance larger spending & loans to private sector. External
current account surpluses have led to comfortable foreign exchange reserves. External debt
problems are a story of the past. Fitch downgraded Iran rating to “B+”.
Macroeconomic policy: The former administration fostered Iran’s integration in the global economy
while the current leadership wants to reduce social & regional disparities and create jobs. Despite
uncertainty, GDP growth accelerated due to the recovery in agriculture - resulting from better weather
– and the performance of the non-oil sector, but it has been due mainly to larger government
spending. GDP growth rate, which was 5.8% last year, was respectable by historical standards, but
failed to meet the development plan target of 7-8% a year to address unemployment. Every year
about 750,000 Iranians join the labor market. Moreover, to catch up with the rest of the Gulf countries,
Iran will need to upgrade its infrastructure and technology. However, investors are nervous about the
nuclear issue. After an initial stimulus, GDP growth is likely to slowdown during 2007-08. The pursuit
of current policies over the longer run would lead to GDP growth rate falling to 4% a year while
inflation would remain double digits. Thus, the independence of the central bank, elimination of
administrative controls, greater exchange rate flexibility, phasing out of subsidies and reinvigorate the
privatization program are the main structural obstacles to growth and job creation.
Budget/Inflation: Over the short run, Iran can afford to follow its “creative” fiscal “expansionary
policy”. With the help of its Oil Stabilization Fund (OSF) resources, it has been able to bring the
budget “into balance” or to reduce significantly the overall fiscal deficit. Otherwise, it would register a
deficit equivalent to 20% of GDP, excluding oil revenues. Subsidies for energy, food and bank credit
are equivalent to 25% of GDP or US$55bn while energy alone accounts for US$38.5bn. Iran imports
refined oil products and sell them domestically at subsidized prices. Inflation fell in 2005 to 10%, but
has been rising again to about 18% due to the expansionary fiscal policy and economic distortions. In
Iran stimulating economic activity to generate jobs through fiscal and monetary policies have resulted
in persistent double digits inflation, which in turn have undermined the goal of achieving high
sustainable growth rates over the medium term.
External sector: The external position is solid with external current account surpluses that are likely
to be repeated in 2007 and 2008. The external debt and debt servicing are at manageable levels.
Worse come to worse, Iran can repay its external debt obligations tomorrow. Foreign exchange
reserves could be in the area of US$60bn by year-end. Nevertheless, Iran is known to impose “silent
ban” when irritated by trading partners. Iran has signed the IMF Article VIII, which refrain from
imposing restrictions on current account payments. Broader UN sanctions are a standing possibility.
Assuming the pursuit of current policies and average oil prices of US$55 a barrel, the current account
would turn into deficit in five years and foreign reserves would drop to 3 months of imports.
Outlook: Iran can afford to defy UN demands for now. The medium-term outlook depends on key
reforms that would have been facilitated by the current oil windfalls.
